These terms govern use of the Aptus Financial website. They do not replace any client engagement letter, application form, lender terms, facility documents or professional advice.

1. About us

This website is operated by Aptus Financial Ltd, a company registered in England and Wales under company number 09615405. Aptus Financial Ltd is authorised and regulated by the Financial Conduct Authority under reference number 806065.

2. Our role

Aptus is a commercial finance broker. We arrange and introduce finance; we are not a lender. Information on this website is general information only and is not a personal recommendation, offer, credit approval or commitment to lend. Any finance is subject to the proposed lender’s assessment, valuation, due diligence, legal requirements and formal approval.

We do not guarantee that finance will be available or that any particular rate, term, valuation, loan amount or completion date will be achieved.

3. Regulated and unregulated finance

Some commercial finance and buy-to-let transactions are not regulated by the Financial Conduct Authority. Whether a particular transaction is regulated depends on its circumstances. We will explain the basis on which we are acting where relevant.

4. Fees, commission and introducers

Aptus may charge a client fee and may receive commission or other remuneration from a lender or third party. Where an introducer is involved, Aptus may share income with that introducer or pay a referral fee. The applicable client fee, when it becomes payable and relevant remuneration information will be set out or explained in the engagement or application documentation before commitment. Where applicable, further information about lender commission is available on request.

5. Website information

We take reasonable care when preparing website content, but products, lender criteria, interest rates, costs and availability can change without notice. You should not rely on website information alone when making a financial, legal, tax or property decision. You should obtain appropriate independent advice.

Any calculator or worked example is illustrative only. It is not a quotation, offer or guarantee and may not include every fee, tax or cost.

6. Applications and third parties

Submitting an enquiry does not oblige Aptus or any lender to provide finance. Any lender approached will apply its own terms, privacy notice, credit assessment and lending criteria. Valuers, solicitors, accountants and other third parties act under their own professional duties and terms. Aptus is not responsible for decisions or services supplied independently by those parties.

7. Intellectual property and acceptable use

Unless stated otherwise, the content, design, branding and materials on this website belong to Aptus Financial Ltd or the relevant licensor. You may view and print reasonable extracts for personal or internal business use. You must not reproduce, alter, sell or commercially exploit website content without written permission.

You must not misuse the website, attempt unauthorised access, introduce malicious code or use the website in a way that is unlawful or infringes another person’s rights.

8. Links and availability

Links to third-party websites are provided for convenience and do not amount to endorsement. We are not responsible for third-party content or availability. We may change, suspend or withdraw any part of this website without notice.

9. Liability

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence. Subject to that, Aptus is not liable for loss caused by reliance on general website information, interruption of the website, third-party websites or events outside our reasonable control. Any liability arising from a client engagement is governed by the applicable engagement terms and law.

11. Complaints

We will handle complaints in accordance with the procedure and regulatory requirements applicable to the relevant service. Where a complainant and complaint are eligible, we will provide information about referral to the Financial Ombudsman Service.

12. Governing law

These website terms are governed by the law of England and Wales. The courts of England and Wales will have jurisdiction, subject to any mandatory rights that apply.

Your property may be repossessed if you do not keep up repayments on a mortgage or other debt secured on it.
